SPA offers No Evidence in Sex case following Alejandra’s submissions on Abuse of Process

Alejandra acted for LCpl M who was charged with Sexual Assault. It was alleged that LCpl M had grabbed the complainant from behind before he licked and kissed the back of her neck, following a day of drinking. The complainant was a member of staff at the bar in which the incident occurred.

Following a range of serious investigative failures by the Royal Military Police, Alejandra drafted an application for the stay of proceedings as an Abuse of Process. Following the submission of Alejandra’s written application, the Service Prosecuting Authority (‘SPA’)  responded to the application by offering no evidence.
