Siân was instructed by Shirley Forbes of the RCN to represent one of two registrants accused of assaulting a vulnerable patient and accessing his mobile phone.
Co-defending with Vithyah Chelvam (Red Lion Chambers), the defence successfully resisted the NMC’s application to admit the absent complainant’s statement as hearsay, while successfully applying to admit NMC disclosure of medical records and internal investigation accounts as evidence before the Panel.
As a result, the NMC decided to offer no evidence against both registrants on all charges.
