Fergus has successfully concluded long-running litigation in the Employment Appeal Tribunal, following earlier proceedings in the Court of Appeal. The Claimant, anonymised as QRS, has issued 4 appeals challenging various tribunal decisions, and was ultimately seeking to re-open the dismissal of her substantive claims at trial in 2024. The appeals have involved a significant amount of procedural wrangling over time limits, and questions of judgment over whether the substantive issues have prospects of success.  His further argument that the issues in the appeals are “academic” in the light of dismissal at trial has now been endorsed by the Court of Appeal and the EAT.
