Victoria Ellis’s practice encompasses all aspects of private family law and the overlapping areas of Inheritance. She has extensive experience representing parties at all stages of non-contentious and contested hearings. Whilst her particular interests include financial remedies cases and all private law children matters, she is routinely instructed in relation to claims under the Trusts of Land and Appointment of Trustees Act 1996, and claims for financial provision under schedule 1 of the Children Act 1989. Victoria is regularly instructed in cases involving vulnerable individuals.

Victoria has a reputation for combining an empathetic manner with assertive and pragmatic legal advice, this was recognised when she was shortlisted for Jordan’s Family Law – Young Barrister of the Year 2015.

Victoria is listed as a ‘Leading Junior’ in Legal 500 and is available to sit as a pFDR Judge.

Legal Services

Victoria has a strong financial practice; she accepts instructions in relation to all stages of proceedings, representing clients from First Direction Appointments through to Final Hearings and covering the full range of applications. Victoria understands the importance of ADR in achieving the best outcome for clients, and is regularly instructed in mediations, arbitrations and pFDRs.

Victoria is experienced in TOLATA cases and in third party interventions in financial remedy.

Selected Cases:

JN v GN [2023] EWFC 244 

Victoria acted for the wife in a Final Hearing where the husband’s conduct has squandered the matrimonial assets. Victoria successfully ran a conduct case which allowed for a significant departure in the wife’s favour in acknowledgement of the husband’s conduct.

CJ v CJ

Victoria represented H in a complex 4.5 day final hearing in which both parties ran multiple conduct arguments, and where further complications arose due to the significant passage of time between separation and divorce. The matter involved assisting to regularise the position following the incorrect pronouncement of Decree Absolute in relation to a void second marriage.

M v N

Victoria successfully represented W in a matter where H sought to resile from a concluded agreement. Victoria secured a finding that the parties were Xydhias bound and that H was to pay the majority of W’s costs.

S v S

Victoria was instructed in relation to proceedings whereby the children’s complex and enhanced needs had a significant impact on the wife’s claims for financial remedies.  Victoria successfully secured the wife an award that allowed her to meet her and the children’s needs now and in the long term on the basis that she no longer had a realistic earning capacity due to her role as the children’s carer.

Victoria has strong experience of private law children matters including those with elements of domestic violence, alcohol and substance misuse, and serious safeguarding concerns. She has represented parents in child arrangement order disputes at every stage of proceedings, including fact-finding hearings. She has successfully obtained and resisted Prohibited Steps Orders and Specific Issue Orders.

Victoria is often routinely instructed in matters involving vulnerable individuals or where the children in question have significant needs.

Selected Cases

R v R

Victoria represented the father in a long running matter, which ultimately concluded in a 19 day Final Hearing, in which the mother had the benefit of substantial and complex special measures, in order to allow her to give her best evidence. The matter was complicated further by the enhanced needs of the children and conflicting professional evidence. Victoria was successful in achieving the orders F sought in order to safeguard the children from significant risk.

B v B

Victoria representing the father in a long running matter over 4 years, where the mother made a number of serious allegations against him, which were ultimately found to be false. Victoria was able to secure findings that the mother had purposely sought to alienate the children from F, and an order than the original child arrangements order where the children spent the majority of their with F reinstated.

G v G

Victoria represented the mother in a matter where the teenage child was in the midst of a mental health crisis and refusing to attend school. The child in question did not wish to spend time with the father. The father sought findings that the mother was failing to meet the child’s needs and alienating them from the paternal family. No findings were ultimately made against the mother and an order of no direct contact was made in relation to the father’s application.

H v S

Victoria represented the mother in a complex matter whereby the father refused to consent to vaccinations and routine medical treatment. The mother was able to obtain the order necessary to allow the children to be treated in line with professional advice.

Victoria has a strong practice in relation to cohabitee disputes. She accepts instructions in domestic TLATA claims and Schedule 1 applications, and has successfully represented client to Final Hearing and also within mediations and arbitrations.

Victoria has a keen interest in the area of Inheritance law, with a particular interest in claims under the Inheritance (Provision for Family and Dependants) Act 1975 and trust of land disputes.
