Rebecca Paterson is a civil barrister, specialising in professional regulation and employment law, with specific expertise in disputes arising within the healthcare sector.
Professional Regulation
Rebecca has a strong background in fitness to practise proceedings, having had robust training during her time as an in-house barrister at the Nursing and Midwifery Council, and previously as a clerk at the Medical Practitioners Tribunal Service. Her former roles give her a unique insight into how cases progress through different stages of the fitness to practise process.
She regularly represents both regulators and registrants in cases involving misconduct, conviction, health, and lack of competence. Her work also includes appearing in the High Court for interim order extension hearings, advising on prospects of appeal, reviewing evidence, and drafting charges for regulators ahead of final hearings.
Rebecca’s regulatory practice is complemented by her experience in employment law, proving helpful in fitness to practise cases arising from workplace disputes or challenging employment contexts.
Employment
Rebecca acts for both Claimants and Respondents across the full spectrum of employment law.
She has experience drafting complex pleadings and representing clients in cases involving discrimination, unfair dismissal, protective awards, and worker status. She advises on restrictive covenants and drafts claims and interim injunctions for companies seeking to enforce them.
She has particular expertise advising medical professionals on the nuances of their employment contracts, including those involving consultant Job Plans, and is adept at navigating the overlap between employment disputes and professional regulation.
Rebecca has provided specialist consultancy services for Paris Smith LLP, and assists firms with finalising settlement agreements.
General Civil
In addition to her core areas of practice, Rebecca regularly appears in the County Court in small claims and fast track trials. She accepts instructions in a range of civil matters including:
Rebecca represented a nurse and Registered Manager facing over 70 allegations of misconduct across three referrals. After an 11-day hearing, she secured a finding of no impairment and the case was taken no further.
Representing a nurse, Rebecca successfully obtained a rehearing before a newly constituted panel after the committee’s draft decision was leaked and transcripts of the registrant’s case were lost.
Through Advocate, Rebecca provided last minute pro bono advice on impairment to a psychologist found guilty of racially motivated misconduct. After identifying significant remediation and mitigation, they secured a finding of no impairment.
Rebecca represented a Superintendent Pharmacist and Responsible Pharmacist in a hearing before the fitness to practise committee concerning the registrant’s involvement in the online sale of medicines during the Covid-19 pandemic.
Acting for the Nursing and Midwifery Council, Rebecca secured findings that a senior nurse responsible for supervision and training within their relevant NHS Trust acted in a sexually motivated manner towards a junior colleague.
Through Advocate, Rebecca represented a Claimant seeking to establish worker status despite having signed a service level agreement indicating self-employment. During a one-day hearing, Rebecca was able to establish that the service level agreement did not reflect the true working relationship, and the Employment Tribunal held the Claimant was a worker/employee within the meaning of s230 Employment Rights Act 1996/s83 Equality Act 2010.
Rebecca represented a Claimant in proceedings involving discrimination related to gender reassignment and disability, securing settlement on the morning of the hearing.
Rebecca successfully acted for the Council in striking out a whistleblowing detriment claim on jurisdictional grounds.

Rebecca has a background in performance. Having commenced London Academy of Music and Dramatic Arts lessons at the age of 6, she continued throughout her education and ultimately achieved Distinction in Grade 8 Speaking of Verse and Prose and a Level 3 Performance Certificate. During University and prior to commencing life at the Bar, Rebecca regularly appeared in productions with her local amateur dramatics society in Preston, ‘The Hall Players’, her all-time favourite role being ‘Maureen’ in Alan Ayckbourn’s ‘Time of My Life’. Since moving to London, Rebecca has been involved in multiple ‘Miscellany’ performances with fellow members of Gray’s Inn.
To stay active, Rebecca enjoys swimming, dancing, and running. This year she intends to complete the Bournemouth Pier to Boscombe Pier open water swim to raise money for the British Heart Foundation.
