Kevin Haven has a civil practice centred around clinical negligence and personal injury work. He was formerly with a leading clinical negligence and personal injury Chambers.

Kevin has over 35 years experience dealing with clinical negligence and personal injury claims, predominantly acting for Claimants but increasingly instructed on behalf of Defendants.

He is recommended as a leading junior in the Legal 500 for clinical negligence and personal injury claims. He is cited for his significant experience in all types of injury litigation, as an excellent tactician in presenting complex injury matters, recognised for his numeracy skills and his ability to explain issues to clients in plain English.

Expertise

Kevin has a broad practice in clinical negligence work undertaken in chambers particularly those cases with complex issues resulting in high value claims requiring life-long care and treatment.

He appreciates the importance to clients in seeking to bring an early resolution to claims, if possible, to enable clients to move on with their lives without the stress of litigation and has successfully brought a number of claims to a favourable resolution through mediation.

He particularly has detailed experience in:

  • Birth injuries – both cognitive and physical
  • Dental / Maxillofacial Claims – with associated blast and burn injuries
  • Liver damages – with associated complications
  • Psychiatric claims – centred on the failure to diagnose and/or provide adequate care and support for a variety of conditions such as Dissociative Identity Disorder (D.I.D.)
  • Renal issues – with a detailed understanding of mitrofanoff surgery

He also has experience of claims arising from management and systems failures including – outsourcing of patients to the private sector and arising from defective products and drugs.

Kevin has a broad practice covering all the major categories of personal injury work and specifically focused upon claims arising in the marine industry during the construction and maintenance of commercial seagoing vessels and in yacht / pleasure craft accidents.

He has dealt with a range of high value marine personal injury claims – including The European Gateway, Herald of Free Enterprise, The Marchioness River Boat tragedy on the Thames, Piper Alpha and St Malo Ferry.

He has also dealt with claims featured on “Holidays from Hell” arising from a school trip on MV Victoria which caught fire off the coast of Cyprus with over 250 children on board and the Turkish Beach Bus crash.

Kevin has significant experience of dealing with motorcycle claims and sporting injuries to professional athletes which have restricted or ended their careers.

In addition, Kevin has also been in a number of large claims on behalf of children and young people with significant psychological and psychiatric injuries – particularly arising in the context of historic sexual abuse claims against care, educational, religious & sporting establishments.

Kevin has extensive experience of the insurance industry – including negligent broking and underwriting.

He was seconded to the Corporation of Lloyds in the 1980’s to work on the bylaws under the Lloyds Act and including the investigations into preferential underwriting.

He subsequently represented Brokers and Underwriters in E & O Claims specifically in the bloodstock industry including the claim relating to Shergar.

He has also co-written the policy wording for a major Insurer’s yacht policy.

In addition, Kevin deals with professional negligence claims involving solicitors – having been a solicitor between 1990 and 1995 during which time he was a partner in a Central London firm and subsequently head of litigation in the regional office of a large national firm.

Beyond qualifying as a mediator Kevin has further trained in workplace / employment mediation and in Advanced Mediation Skills.

Kevin will carry out mediations in his core practice areas of personal injury, clinical negligence and professional negligence.

In addition to Kevin’s main areas of practice he has extensive practical experience which can assist in mediations relating to:

Business / Maritime Industry

Having run family businesses he has experience in dealing with employment, financial issues and distributorships – with working knowledge in:.

  • Bloodstock syndicate disputes
  • Property development and contractual disputes arising during project management
  • Licensed trade disputes – Kevin holds a BIIAB personal license and other qualifications relevant to licensed trade management and has managed large, licensed premises.
  • Yacht racing – holding the RYA/DOT Yachtmaster ticket he has practical experience with Yacht racing rules and the protest procedures.
  • Managing yachting corporate events
  • Yacht building / construction disputes

Education

Kevin is a former University Governor from which he has had experience of the University Appeals process in sitting on appeals panels determining disputes arising from:

  • Students’ educational disputes / exclusions
  • Staff employment / disciplinary / redundancy disputes

He has also had experience of management and employment disputes arising in schools under special measures and dealing with issues arising in admissions / exclusions.
