Alvaro Loxton persuades Southampton Magistrates’ Court to impose short disqualification instead of licence revocation for speeding

Alvaro Loxton, a pupil in chambers, successfully persuades Southampton Magistrates’ Court to disqualify for 28 days rather than revoke the license of a young driver for speeding.

The client was charged under Section 89(1) of the Road Traffic Regulation Act 1984 for speeding at 60mph in a 30mph zone. The client was at danger of being disqualified, and as a newly qualified driver, automatic revocation of his licence and a prolonged re-test. The guidelines on driving disqualification for the Magistrates are clear that this is almost always the course of action a court should take.

However, Mr Loxton drew the court’s attention to the client’s good character and his achievements in the year since the offending. He was able to persuade the court that a sentence of 28 days’ disqualification and the payment of court fees would unusually suffice in this case, thus avoiding the revocation of his license.
