In Re: V (Appeal: Relocation) [2024] EWHC 2600 (Fam) Maria Henty, instructed by Kate Barber and Emily Gulliver of Thrings, was successful in the High Court on appeal before Ms Justice Henke. The judgment was handed down for publication on 15 October 2024. Maria acted for the respondent mother on appeal. The mother was successful at first instance and was given permission to relocate with the child to the North. The case is a timely reminder of the paramountcy of welfare, the need for the court to carry out a holistic balancing exercise, and for appellants not to import and hyper fixate on their own language when analysing a judgment. The decision provides a handy precis of the role of the appellant court and in particular, the exercise of reviewing the decision at first instance. Unsurprisingly, reference is made to Piglowska v Piglowski [1999] UKHL 27 and Re H-W [2022] UKSC 17.
