Siân, instructed by Rebecca Austin of the RCN, represented a care home manager accused of several charges relating to failures in care for an end-of-life resident and a number of failings in the home identified within a CQC report. The Registrant accepted the charges relating to the CQC findings but denied those in respect of the resident. The disputed charges were not found proved at the conclusion of stage one and therefore the issue of misconduct and impairment related solely to those charges proved by admission. The case resumed part heard. Following extensive mitigation and remediation evidence, which was unchallenged by the NMC, the panel returned a finding of no misconduct in respect of four of the charges, with misconduct found on the remainder. When considering the issue of current impairment, the panel was satisfied that the conduct, which dated back several years, could and had been sufficiently remediated such that the Registrant’s fitness to practice was not currently impaired.
