Casey Chard represented a man who was due to be sentenced for one offence of racially aggravated ABH and one offence of threatening a person with a knife in a public place. The ABH offence fell in the highest category of harm, owing to a facial cut caused to the victim.
Casey advanced strong mitigation, referring to a psychiatric report, and invited the Court to reduce culpability in line with the guidelines for sentencing offenders with mental disorders, developmental disorders, or neurological impairments. The Court found that owing to the extensive mitigating features, it could depart from Sentencing Guidelines and imposed a Community Order.
