Tim Akers obtains decision of No Further Action after Traffic Commissioner’s Insolvency Concerns

News 26th January 2023
Tim Akers

At a Public Inquiry before the Deputy Traffic Commissioner for the West of England, Tim represented the national arm of a global supply chain management company. The company was called to Inquiry after the Traffic Commissioner raised concerns over the fact that a director had been involved in numerous companies that had become insolvent. Tim drafted detailed written submissions, relying upon the principle that a history of involvement with dissolved companies, without any evidence of actual wrongdoing, will not of itself amount to a loss of repute. At the hearing, and in accordance with the written submissions, the Deputy Traffic Commissioner found no cogent evidence of improper conduct on behalf of the relevant director, and no further action was required.
