Siân Beaven represented C, a vulnerable adult, before High Wycombe Magistrates’ Court, who was charged with an offence under s.2 of the Prevention from Harassment Act 1997. It was alleged that the defendant had contacted the complainant repeatedly over text message spanning over a hundred messages over the course of a month. She later turned up unannounced to the complainant’s home after he had blocked her number. Following a robust cross-examination of the complainant’s repeated engagement with the messaging and the defendant’s clear desire to retrieve sentimental property of hers from him, the magistrates’ accepted that the defendant did not pursue a course of conduct that she knew or ought to have known amounted to harassment and returned a not guilty verdict.
