Justin Gau successfully appealed the penalty of ‘removal from office’ of a clergyman who, although acquitted of adultery, fell to be dealt with for his misconduct in failing to refer the woman to the Diocesan safeguarding team and for swearing at her. The original tribunal had determined that the witness had behaved with ‘egregious’ dishonesty and that her behaviour was ‘chilling’.
This long running and involved case had ‘extraordinary features’ and the judgment criticised the investigation and identified ‘procedural concerns’ in the way that certain evidence was placed before the Court by the complainant Archdeacon.
