All that Glitters is not Golden

Past Events
10th Jun 2020, 12:30 to 13:30

In this lunchtime webinar Professor Robert Howard (UCL) will be joined by Leslie Samuels QC & Mark Dubbery to discuss ‘the Golden Rule’, that where testamentary capacity is in doubt advice should be sought from a medical practitioner.

Professor Howard and Leslie Samuels QC will consider the following issues:

  • Has the recent case law changed the importance or interpretation of the Golden Rule?
  • Why is the Golden Rule so difficult to obey?
  • Does it really make much difference in a Will dispute if the Golden Rule has been followed?
  • Why are doctors often poor at fulfilling their Golden Rule role?
  • What can a solicitor do to get the best out of a medical capacity assessment?
  • Do the Courts adequately recognise the importance of vulnerability to influence (undue or otherwise) in people with dementia?
