Judgment was handed down today (15 May 2020) in the case of Morton v Eastleigh Citizens Advice Bureau for whom Gary has acted throughout, instructed by Laurence Dunn of DC Commercial. The original Tribunal dismissed the Claimant’s assertions re the scope of her asserted disability and that Judgment was upheld by Lavender J in the Employment Appeal Tribunal. The primary issue in the case, however, revolved around whether or not there should have been a postponement of the original hearing and the Court of Appeal Judgment is a clear statement of the limited scope for appealing Case Management Orders in the Employment Tribunal, thereby demonstrating the importance of getting the hearing right first time.
