Successful dismissal in the Court of Appeal in Re B (A Child) [2018] EWCA Civ 2127

Acting on behalf of the respondent father and local authority respectively, counsel John Ker-Reid and Maria Gallagher of Pump Court Chambers, have successfully sought the dismissal of an appeal in the above case. The appeal brought by the mother, related to a decision given by Recorder Miller in July 2018 following a 5 day fact-finding in ongoing care proceedings. The Court of Appeal was asked to consider two matters: the extent of the obligation to cross-examine witnesses about accusations made against them, and the correct legal approach to determining responsibility for inflicted injuries where there are only two potential perpetrators.
