Mark Ruffell successfully represents solicitor before Disciplinary Tribunal

Mark Ruffell has successfully mitigated on behalf of a solicitor who admitted contacting her imprisoned client by mobile phone; sending him 102 text messages in less than three months.

In mitigation before the Solicitors Disciplinary Tribunal, Mr Ruffell said that at the time his client set up her own practice, she did not appreciate “the stresses and strains” it would entail. With hindsight she had realised that she did not have the depth of experience needed. Her fear of losing clients and her desire to succeed in the difficult post-legal-aid-cuts market only intensified the pressures that she was under.

The Solicitors Disciplinary Tribunal imposed an 18-month suspension after deciding the public interest was best served by allowing the client to return to practise in due course.
